TERMS & CONDITIONS

Use of the Car Park
1. To enter and exit the Laver Drive Car Park (“Car Park”), you must (subject to 2 below) collect a ticket at the entry upon arrival and execute a credit card payment at the boom gate at the exit of the Car Park upon departure. Lost tickets will attract the maximum car parking fee that is applicable at the time of the ticket being declared as lost.
2. Pre-paid swipe cards can be purchased online at www.laverdrivecarpark.com.au
3. RPA Properties Pty Ltd (“we”, “us”, “our”) may at any time without notice and at our discretion revoke our authority for you to enter and use the Car Park.
4. You must comply with all signs erected in the Car Park and all lawful directions and requests made by us or our employees, subcontractors or agents in connection with entry to and use of the Car Park, including (without limitation) parking only in marked spaces.
5. You must not do anything in the Car Park that may constitute a nuisance, annoyance or danger to any person or property or to any part of the Car Park (including, but not limited to, parking your vehicle so as to obstruct or prohibit the free passage of any other vehicle) or the surrounding commercial premises.
6. You must not litter the Car Park or allow your vehicle to spill or leak oil within the Car Park.
7. Unregistered and/or abandoned vehicles left in the Car Park will be reported to the Queensland Police Service and may be moved and/or removed from the Car Park and/or subsequently disposed of.

Liability and Indemnity
8. You, your vehicle and its occupants enter and use the Car Park entirely at your risk and we will not be liable for any loss, damage or injury to you or any person or property however caused.
9. By entering the Car Park, you waive any rights you may have, release us from any liability and agree not to make a claim of any kind against us in relation to any loss, damage or injury which may be sustained by you or to your vehicle in relation to the act or omission of us or any third party. We are not liable for theft of your vehicle or any property from your vehicle, or damage to your vehicle by third parties including through a collision between vehicles.
10. You agree to indemnify us from any claim made against us, our employees, subcontractors or agents in connection with any death, personal injury or damage to any property directly or indirectly caused or contributed to by:
(a) the unsafe or illegal operation of a vehicle in or around the Car Park;
(b) the non-compliance with these terms and conditions;
(c) negligence or misconduct; and/or
(d) any wilful, intentional or malicious act, by you or any person authorised by you, to operate your vehicle in the Car Park,
except to the extent that any negligent act or omission by us, our employees, subcontractors or agents contributed to the claim.

Claim
11. You further agree to indemnify us and our employees, subcontractors and agents from and against any claim against us and/or our employees, subcontractors and agents in respect of:
(a) any loss, damage or injury directly or indirectly sustained by us or by any other person that is caused or contributed to by you or any person authorised by you to operate your vehicle in the Car Park;
(b) the observance or non-observance (as the case may be) of any of your obligations under these terms and conditions; and
(c) defending or settling any such claim, provided that you will be entitled to have the handling and control of any such claim as may be the subject of this indemnity.
12. The indemnity contained in 10 and 11:
(a) is a continuing obligation and it is not necessary for us to incur expense or make payment before enforcing a right of indemnity we may have under these terms and conditions; and
(b) does not cover any claim caused or contributed to by our negligent act, omission or default or that of any of our employees, subcontractors or agents to the extent of our negligent act, omission or default or that of any of our employees, subcontractors or agents.
13. To the maximum extent permissible by law, in the case of any guarantees, warranties or conditions implied into these terms and conditions by the Competition and Consumer Act 2010 (Cth), our liability is limited to:
(a) providing the services to you again;
(b) we cannot guarantee availability of a car park but if one is not available, exit from the car park will be free of charge for a period of ten minutes after time of entry
(c) the payment of the cost of having the services supplied again;
(d) a refund of some or all of the standard parking fees, whichever was paid by you.

Lost Tickets
14. If you lose your parking ticket you will need to call 07 5571 5365 to exit the car park. Charges may apply.

Governing Law
15. These terms and conditions and your booking are subject to the laws of Queensland and the parties submit to the non-exclusive jurisdiction of the courts of Queensland situated at Brisbane.

Interpretation
16. In these terms and conditions unless the contrary intention appears:
(a) a reference to the terms and conditions or another instrument includes any variation or replacement of any of them;
(b) a reference to a statute, ordinance, code or other law includes regulations and other instruments under it and includes any consolidations, amendments, re-enactments or replacements of any of them;
(c) the singular includes the plural and vice versa;
(d) the word “person” includes a firm, a body corporate, an unincorporated association or an authority;
(e) unless specifically stated otherwise, a reference to a person includes a reference to the person’s executors, administrators, successors, substitutes (including, without limitation, persons taking by novation) and assigns;
(f) a reference to any thing (including, without limitation, any amount) is a reference to the whole and each part of it and a reference to a group of persons is a reference to all of them collectively, to any two or more of them collectively and to each of them individually;
(g) headings are not binding and are inserted for convenience and reference only.
17. In the event that any provision or part of any provision of these terms and conditions is held to be unenforceable or invalid by a court of competent jurisdiction, the validity and enforceability of the remaining provisions or part of any remaining provisions shall not be adversely affected. The offending provision or offending part of a provision shall be read down to the extent necessary to give it legal effect or shall be severed if it cannot be read down, and the remaining part and provisions of these terms and conditions shall remain in full force and effect.

Comments and Complaints
18. Any comments or complaints relating to our Online Payment Service should be made in writing and sent to info@laverdrivecarpark.com.au
19. We will endeavour to answer your complaint within 5 business days, however we do not guarantee that we will do so.
20. If you wish to make a comment or complaint that is related to an accident or other incident which causes loss, damage or injury, please do so as quickly as possible after the incident.

Acknowledgement upon entry
21. By entering the Car Park you acknowledge having read these terms and conditions in full and agree to be bound by them to the maximum extent permissible by law.
